TICKET & ENTRY TERMS & CONDITIONS

These terms and conditions (“Terms and Conditions”) apply to FLYING LEGENDS 2023; please read them carefully before purchasing any tickets. All tickets are sold or provided subject to availability and to these Terms and Conditions.

1.           Information

1.1         FLYING LEGENDS 2023 (the “Event”) is organised by The Fighter Collection Limited (registered company no. 1972741) (the “Event Organiser”), its contractors, servants and agents.

1.2         These Terms and Conditions create a legal agreement between you and the Event Organiser relating to your booking and attendance at FLYING LEGENDS 2023. These Terms and Conditions also apply to entry by any person holding a contractor admission or temporary passes.

1.3         FLYING LEGENDS 2023 is an advanced ticket event only; Tickets are not available to purchase at the (gate) event site.

1.4         Any access within areas controlled by FLYING LEGENDS 2023 is by permission only. The purchaser or holder of a ticket (the “Ticket Holder”) is permitted entry (valid only for the applicable date(s) to which the ticket(s) relates to).

1.5         Access to the FLYING LEGENDS 2023 car parks is not permitted without a car parking permit which must be purchased in advance.

1.6         Access for Ticket Holders to applicable areas shall be permitted during the following times            (subject to change at the Event Organisers’ discretion, including, but not limited to, operational or health, safety and welfare matters):

              Car Parks            7:00am to 8:00pm

              Event Site           8:00am to 8:00pm

              Flightline            9:00am to 12:30pm (last admittance 12:00pm)

2.           Cancellations, date changes and lost tickets

2.1         All ticket sales are final and refunds will not be given for reasons outside of the event organisers control ie. cancellation of ticket, lost, defaced or damaged tickets etc. Tickets are non-transferrable and cannot be changed or altered in any way once purchased. Ticket holders are advised to check their tickets carefully on receipt and contact us immediately if there is a mistake by calling the box office on +44 (0)131 526 4470 or by Email at flyinglegends@180boxoffice.com

2.2         The Ticket Holder shall not sell or attempt to sell the ticket to any third party.  Your ticket has no monetary value and is not for resale.

2.3         At point of sale only, the Ticket Holder may purchase an optional Booking Refund Protection. Cover is provided by ‘Booking Protect’ and begins at the time the ticket is purchased and ends at the beginning of the event, ie. with entry into the location at which the event takes place. If the entitled person is unable to attend FLYING LEGENDS 2023 because of an insured event, ‘Booking Protect’ will reimburse the contractually-liable cancellation costs up to the level of the agreed sum insured. Charges relating to administrative costs or for the insurance premium will not be reimbursed. The Ticket Holder acknowledges that the said captioned insurance policy confers no additional liability upon the Event     Organiser and that all such liabilities in respect of the optional booking refund protection shall be discharged wholly and in its entirety by ‘Booking Protect’.

3.           Attendance at FLYING LEGENDS 2023

3.1         The Ticket Holder agrees to follow all reasonable instructions of the Event Organiser, event staff, security, Police and Emergency Services during FLYING LEGENDS 2023.

3.2         The Ticket Holder acknowledges that the Event Site is subject to strict security arrangements and that the Event Organisers may carry out security checks (including, but not limited to, checks of the Ticket Holder’s person, belongings and vehicle).

3.3         The Ticket Holder shall act responsibly at all times and not do anything to endanger the safety of any person or property at the Event. Minors under the age of 18 must be accompanied and supervised by and adult at all times.

3.4         Shelters and stepladders are not allowed to be bought into FLYING LEGENDS 2023.

3.5         Smoking (including vaping) within the Event site is only allowed in Outdoor Designated Smoking Areas, as determined by the Event Organiser and indicated with appropriate signage and is not allowed in any event structure at FLYING LEGENDS 2023 or within 10 metres of any aircraft.

3.6         The following items are prohibited and may not under any circumstance be brought onto the Event Site: explosive substances or materials, pyrotechnics, Chinese lanterns, offensive weapons and firearms (including replica or toy firearms); projectiles and similar devices; placards, flags, banners, signs, brochures and leaflets intended for distribution to the public; megaphones, amplifiers, loud speakers; lights and laser pointers; paint, chemicals, spray cans and other associated apparatus; illegal drugs, new psychoactive substances (NPS, legal highs, bath salts, research chemicals, designer drugs or herbal highs); excessive amounts of alcohol; Gazebos, windbreaks and oversized umbrellas; kites, remotely controlled model aircraft, drones or similar devices; barbecues, gas bottles, camping stoves, naked flames etc; birds or animals (excepting guide & assistance dogs) including any within vehicles in the car parks and any other item which, in the opinion of the Event Organiser, may cause personal injury or property damage, disruption to FLYING LEGENDS 2023, public nuisance or inconvenience, offence or distress or security risks.

3.7         The Ticket Holder acknowledges that the flying of drones or small unmanned aircraft is prohibited in or around the airspace of Leeds East Airport; Article 239 of the Air Navigation Order grants FLYING LEGENDS 2023 Restricted Airspace between Friday 14 and Sunday 16 July to allow safe conduct of the event and contravention constitutes a criminal act.

3.8         Ticket Holders should keep their personal belongings with them at all times and the Event Organiser accepts no liability for damage to, or loss (including theft) of, personal belongings or vehicles while on or at the venue.

3.9         Additional terms relating to the venue and FLYING LEGENDS 2023 may be notified by the Event Organiser to Ticket Holders by notices prominently displayed at the Event Site during FLYING LEGENDS 2023 and such additional terms shall be deemed incorporated into these Terms and Conditions.

3.10      The Event Organiser reserves the right to refuse admission to FLYING LEGENDS 2023, or to remove any person or vehicle from the Event Site or any particular area for reasons of public safety, unacceptable behavior likely to cause damage, nuisance or injury, or for any breach of these Terms and Conditions without refund or compensation.

4.           Parking Permit, Car Share & Blue Badge scheme

4.1         Parking permits are dispatched by post prior to the event. If you intend to travel to FLYING LEGENDS     2023 by car, please ensure that you display your parking permit prominently on arrival at the car parks. Parking permits are not available at the gate and you will be refused entry to the car parks without a valid parking permit.

 4.2        A ‘Car Share’ parking permit is available to Ticket Holders who purchase 3 or more, same day, ADULT admission tickets within the same transaction. The event ticketing provider (180 Box Office) will review all such applications to ensure the criteria is correctly satisfied. Where a Ticket Holder does        not satisfy the ‘Car Share’ criteria the parking permit will be revoked; The Ticket Holder will be               contacted and required to complete the purchase of the appropriate parking permit.

4.3         FLYING LEGENDS 2023 operates a limited Blue Badge parking scheme; Blue Badge parking must be booked by calling the box office on +44 131 526 4470 and is allocated on a first come, first served basis. Proof of entitlement (blue badge or international equivalent) will be requested on arrival and entry refused if not displayed. Your Blue Badge must be used in conjunction with a valid parking permit (Para 4.1).

4.4         Parking permits should be received not later than 14 days before FLYING LEGENDS 2023; if your permit does not arrive before this time please contact the box office flyinglegends@180boxofffice.com

4.5         The site is mainly grass and generally is well drained and short but we recommend suitable clothing and footwear be worn to accommodate this type of terrain. Some parking areas may be inaccessible during the airshow to satisfy the requirement of Civil Aviation Authority CAP403; Ticket Holders will not be permitted to return to their vehicles until the cessation of all flying activities for their own safety and the safety of others.

 4.6        No vehicle shall be permitted to remain in the car parks the preceding night or overnight and all vehicles must be removed from the car parks at the end of the Event.

5.           Filming, Photography and other content

5.1         The Ticket Holder shall not without the Event Organisers’ prior written consent sell, license, or otherwise commercially exploit, or attempt to commercially exploit, any material relating to FLYING LEGENDS 2023 whether written or in the form of digital or photographic film, sound, video including livestreaming or other recording or computer software whether obtained or made at the Event Site or      within the Car Park areas or otherwise.

5.2         The Ticket Holder acknowledges that the events held at Leeds East Airport may be photographed or filmed. The Ticket Holder agrees to the use and exploitation of video or picture images or recordings   including sound featuring the Ticket Holder taken by or on behalf of the Event Organiser during or in    connection with FLYING LEGENDS 2023 for any and all purposes determined by the Event Organiser,          including for commercial purposes, in any and all media whatsoever (whether in existence now or in the future) around the world without further authorisation, notification or payment. The Ticket Holder hereby waives any rights of objection in connection with such use or any so-called personality, image or privacy rights in connection with such use.

6.           Cancellation and changes to FLYING LEGENDS 2023

6.1         The Event Organiser reserves the right at any time to cancel or postpone FLYING LEGENDS 2023 or to cancel, postpone or vary any element comprising part of FLYING LEGENDS 2023, including, due to     any event outside of the reasonable control of the Organisers affecting the performance of its obligations, or the running of FLYING LEGENDS 2023, including without limitation, unavailability of the venue or participants, civil commotion, riot, invasion,  national mourning, terrorist attack or threat of terrorist attack, war (whether declared or not), natural disasters, adverse weather conditions, pandemic or epidemic or any law or action taken by a government or public authority.

6.2         We will contact you as soon as is reasonably possible to notify you of any cancellation or rescheduling of FLYING LEGENDS 2023. Please be aware that it may be necessary to cancel FLYING LEGENDS 2023 and announce rescheduled dates on short notice.

6.3         Should weather or other circumstances require flying to be curtailed or restricted, where possible aircraft will be taxied and other exhibits and ground displays will be available. For the avoidance of doubt, this shall not constitute a cancellation of FLYING LEGENDS 2023.

6.4         In event of cancellation or rescheduling of FLYING LEGENDS 2023, the Event Organiser may offer Ticket Holders tickets to a substitute or rescheduled event or the option to donate the ticket price as a donation as an alternative to receiving a refund, or Ticket Holders may instead opt to receive a refund. Where tickets to a substitute or rescheduled event are available, you will be notified and given not less than 30 days from the date of notice of cancellation of the Event in which to confirm your preference (unless the rescheduled or substitute event is to be held sooner than 30 days from the date of notice of cancellation, in which case you may be offered the option of a ticket to that event or an alternative substitute event to be held at a later date). In the absence of a response within such period, the Event Organiser will provide you with tickets to a substitute or rescheduled event. Refunds will be paid within 14 days beginning on the date on which you confirm to the Event Organiser you wish to receive a refund (or if no substitute or rescheduled event is offered, 14 days after confirmation that no substitute or rescheduled event will be offered). Charges relating to administrative costs will not be reimbursed. If the Event Organiser cannot make payment of refunds within these periods due to events outside of the reasonable control of the Event Organiser, you will be kept informed and payments will be made within a reasonable time.

6.5         The Event Organisers’ liability for cancellation or rescheduling or failure to deliver FLYING LEGENDS 2023 shall be limited to providing tickets to a substitute or rescheduled event or providing a refund in accordance with paragraph 6.4; the Event Organiser shall have no further liability to any Ticket Holder in relation to any other costs or expenses, including without limitation, the costs of any travel,        accommodation or other arrangements made in connection with the Ticket Holders attendance at the Event.

7.           Public Health:

7.1         The Ticket Holder acknowledges the Event Organises right to apply, vary, or alter such health restrictions, warnings or guidance as it considers necessary to protect the public health as a condition of entry and behavior in response to any guidance or requirement issued by the United Kingdom Government, Public Health England, local or regulatory authority; such restrictions, changes or alterations may be notified by the Event Organiser to Ticket Holders by notices on the Flying Legends website, social media, by Email or by notices prominently displayed at the Event Site during FLYING LEGENDS 2023. Such additional terms shall be deemed incorporated into these Terms and Conditions.

8.           Liability:

8.1         For the avoidance of doubt, within the following prescribed paragraphs the “LEGAL Parties” shall mean, ‘Makin Enterprises Limited’ and the ‘Event Organiser’ together with their       respective Affiliates, employees, contractors, servants and agents.

8.2         Nothing in these Terms and Conditions shall limit the liability of any of the LEGAL Parties for death or personal injury resulting from its negligence or for any other liability which cannot be excluded by law.

8.3         Whilst the Event Organiser takes reasonable care to ensure the safety of the event, the Ticket Holder    acknowledges that they may be exposed to possible risk of physical harm or property damage due to the nature of FLYING LEGENDS 2023 and the Ticket Holder enters and brings any vehicle or property onto the Event Site and surrounding areas entirely at their own risk and volition.

8.4         Other than where the Ticket Holder suffers personal injury or death or property damage resulting from the negligence of a LEGAL Party (Para 8.2), the Ticket Holder acknowledges that the LEGAL Parties will not be liable for any loss or damage that the Ticket Holder may suffer as a result of purchasing a   ticket and/or gaining access to the Event Site. This exclusion applies whether the liability arises in contract or civil tort (including negligence and negligent misstatement) or for misrepresentation, breach of statutory duty or otherwise.

8.5         Other than where the Ticket Holder suffers personal injury or death or property damage resulting from the negligence of a LEGAL Party (Para 8.2), in no circumstances will the LEGAL Parties be responsible to the Ticket Holder for any economic loss of any kind, loss of profits, loss of contracts, loss of earnings or loss of revenues or for any indirect or consequential loss or damage.

8.6         Other than where the Ticket Holder suffers personal injury or death or property damage resulting from the negligence of a LEGAL Party, the maximum aggregate liability on the part of the LEGAL Parties shall be limited to the face value of the ticket of the relevant Ticket Holder.

9.           Data Protection:

9.1         The Ticket Holder acknowledges that in connection with purchasing tickets for or attending FLYING LEGENDS 2023, the Ticket Holder will provide the Event Organiser with certain personal data, such as names and contact details.

9.2         The Event Organiser is the controller of your data and are committed to ensuring your personal data is stored safely and in compliance with all applicable data protection legislation in force from time to time in the UK. We will process your personal data in accordance with our privacy policy: www.flying- legends.com/privacy.

10.         General:

10.1      The Event Organiser may transfer its rights and obligations under the Terms and Conditions to another organisation, but this will not affect your rights or the Event Organisers obligations under these Terms and Conditions and you will be notified in writing if this happens. You may only transfer your rights or your obligations under these Terms and Conditions to another person with the written consent of the Event Organiser.

10.2      These Terms and Conditions constitute the entire agreement between the Event Organiser and the Ticket Holder.  You acknowledge that you have not relied on any statement, promise or representation made or given by or on behalf of the Event Organiser which is not set out in these Terms and Conditions.

10.3      If for any reason any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable, such provision shall be severed and the remainder of the Terms and Conditions shall      continue in full force and effect.

10.4      The LEGAL Parties may enforce their rights and enjoy the benefits given under paragraphs 8 of these Terms and Conditions against the Ticket Holder. Otherwise, a person who is not a party to the          agreement formed between the Event Organiser and the Ticket Holder on these Terms and Conditions     will not have any right to enforce or enjoy the benefit of any provision of these Regulations.

10.5      These Terms and Conditions shall be governed by and construed in accordance with English law and the Ticket Holder agrees to submit to the exclusive jurisdiction of the English courts over any matter arising under or in connection with these Terms and Conditions.
